What is Najem Okazjonalny and why do you need a guarantee?

If you rent an apartment in Poland, you may have come across the term Najem Okazjonalny — a special form of rental agreement that landlords increasingly use to protect themselves from unreliable tenants.

📘 What is Najem Okazjonalny?
Najem Okazjonalny is a temporary rental agreement that can only be concluded at a notary’s office. It allows the landlord to quickly and legally evict a tenant in case of:

  • non-payment,

  • violation of the contract,

  • refusal to vacate the property at the end of the rental period.

⚠️ For this contract to be valid, it must include a document specifying where you will move if the landlord takes legal action.

🔐 What is a guarantee?
A guarantee is a document in which:

  • it is stated that you have a place to move to in case of eviction;

  • or a person (guarantor) declares that they will host you if the rental contract is terminated.

🔎 This document is attached to the Najem Okazjonalny contract and signed at the notary’s office. Without it, the notary cannot conclude the rental agreement!
